California's chief justice, a GOP appointee, says death penalty no longer effective in state

Chief Justice Tani Cantil-Sakauye, who heads California's judicial branch and its highest court, said in an interview that the death penalty is no longer effective in California and suggested she would welcome a public debate on its merits and costs.

As she prepared to close up shop for the holidays, the Republican appointee and former prosecutor made her first public statements about capital punishment a year after she took the helm of the state's judiciary and at a time when petitions are being gathered for an initiative to abolish the death penalty.

"I don't think it is working," said Cantil-Sakauye, elevated from the Court of Appeal in Sacramento to the California Supreme Court by former Gov. Arnold Schwarzenegger. "It's not effective. We know that."

California's death penalty requires "structural change, and we don't have the money to create the kind of change that is needed," she said during an interview in her chambers. "Everyone is laboring under a staggering load."

In response to a question, she said she supported capital punishment "only in the sense I apply the law and I believe the system is fair. ... In that sense, yes."

But the chief justice quickly reframed the question.

"I don't know if the question is whether you believe in it anymore. I think the greater question is its effectiveness and given the choices we face in California, should we have a merit-based discussion on its effectiveness and costs?"

Cantil-Sakauye's comments suggest a growing frustration with capital punishment even among conservatives and a resignation that the system cannot be fixed as long as California's huge financial problems persist.

Her predecessor, retired Chief Justice Ronald M. George, was similarly disheartened. A former prosecutor who defended the state's death penalty before the U.S. Supreme Court, George concluded in his later years on the California Supreme Court that the system was "dysfunctional."

Cantil-Sakauye, 53, alluded to the proposed ballot measure to replace the death penalty with life without possibility of parole but declined to say whether she supported that plan.

"That really is up to the voters or to the Legislature," she said, asking whether the criminal justice system can "make better use of our resources."

In her first year on the state high court, Cantil-Sakauye has more often sided with its conservative justices than its more moderate jurists, said Santa Clara University law professor Gerald Uelmen, an expert on the court. He said her early track record shows her as more conservative than George, who was a key swing vote on the seven-member court.

Uelmen called the chief justice's comments on the death penalty "powerful" and said they confirmed what he has been hearing privately - that even the conservatives on the California Supreme Court have grown disillusioned with the state's capital punishment system.

Men and women on death row are far more likely to die of old age than by the executioner's needle. Litigation has brought executions to a halt, and there is a shortage of lawyers willing to take capital cases. Inmates must wait an average of five years before getting lawyers to bring their first appeal.

Cantil-Sakauye has written a ruling affirming a death sentence and joined other justices' decisions upholding capital sentences since her elevation to the high court last January. Her biggest ruling came in a Proposition 8 case in which she said initiative sponsors have the right to defend their ballot measures in court when state officials refuse to do so.

The chief justice indicated during the interview that she is probably still too new on the court for outsiders to assess her judicial philosophy. Most of her first year was dominated by administrative matters, particularly budget cuts, she said.

She spends more time with Justice Marvin R. Baxter than any other member of the court because he serves with her on the Judicial Council, the policymaking body for the judiciary, she said. Baxter is considered the court's most conservative member.

Emboldened by monitors, Syrians hold huge protests (AP)

BEIRUT ? In the largest protests Syria has seen in months, hundreds of thousands of people took to the streets Friday in a display of defiance to show an Arab League observer mission the strength of the opposition movement.

Despite the monitors' presence in the country, activists said Syrian forces loyal to President Bashar Assad killed at least 22 people, most of them shot during the anti-government demonstrations.

In a further attempt to appeal to the monitors, dissident troops who have broken away from the Syrian army said they have halted attacks on regime forces to reinforce the activists' contention that the uprising against Assad is a peaceful movement.

While opposition activists are deeply skeptical of the observer mission, the outpouring of demonstrators across Syria underscores their wish to make their case to the foreign monitors and take advantage of the small measure of safety they feel they brought with them.

The nearly 100 Arab League monitors are the first that Syria has allowed into the country during the uprising, which began in March. They are supposed to ensure the regime complies with terms of the League's plan to end Assad's crackdown on dissent. The U.N. says more than 5,000 people have died as the government has sought to crush the revolt.

Friday's crowds were largest in Idlib and Hama provinces, with about 250,000 people turning out in each area, according to an activist and eyewitness who asked to be identified only as Manhal because he feared government reprisal. Other big rallies were held in Homs and Daraa provinces and the Damascus suburb of Douma, according to Rami Abdul-Raham, who heads the British-based Syrian Observatory for Human Rights.

The crowd estimates could not be independently confirmed because Syria has banned most foreign journalists from the country and tightly restricts the local media.

Haytham Manna, a prominent Paris-based dissident and human rights defender, said the observers' presence has emboldened protesters to take to the streets in huge numbers.

"Whether we like it or not, the presence of observers has had a positive psychological effect, encouraging people to stage peaceful protests ? a basic condition of the Arab League peace plan," he told The Associated Press.

The observers began their mission Tuesday in Homs, often referred to by many Syrians as the "Capital of the Revolution." Since then, they have fanned out in small groups across Syrian provinces, including the restive Idlib province in the north, Hama in the center and the southern province of Daraa, where the revolt began.

The orange-jacketed observers have been seen taking pictures of the destruction, visiting families of victims of the crackdown, and taking notes.

On Friday, they were within "hearing distance" from where troops opened fire on tens of thousands of protesters in the Damascus suburb of Douma, activist Salim al-Omar said. They later visited the wounded in hospital, he added.

Despite questions about the human rights record of the man leading the monitors, tens of thousands have turned out this week in cities and neighborhoods where they were expected to visit.

The huge rallies have been met by lethal gunfire from security forces, apparently worried about multiple mass sit-ins modeled after Cairo's Tahrir Square. In general, activists say, security forces have launched attacks when observers were not present. But there have been some reports of firing on protesters while monitors were nearby.

Omar Shaker, an activist and resident of the battered neighborhood of Baba Amr in Homs, said the observers were "laughable," often walking around with outdated cameras and without pens.

"Still, the bombardment and killings have decreased here in their presence. We see them as a kind of human shields, that's all," he said.

Shaker said around 7,000 protested Friday in Baba Amr ? the first demonstration in the besieged district in more than a week.

"People are feeling optimistic," he said. "We've been protesting and dying for 10 months. We have the feeling that the worst is over and the end is near," he added.

In Douma, up to 100,000 people protested Friday. Amateur videos posted on the Internet by activists showed demonstrators carrying away a bleeding comrade after being hit by a gas canister.

"Look, Arab League, look!" the cameraman is heard shouting. The British-based Observatory, which relies on a network of activists on the ground, said the regime used nail bombs against protesters in Douma. The report was confirmed by Douma activist al-Omar.

In another video, a huge crowd packed a main street in Homs, singing anti-Assad songs and dancing in unison. The crowd sang, "We will die in freedom," to the festive beat of a drum, as the unidentified cameraman proclaimed, "For months we didn't hear anything on Friday" because of the crackdown. "But because of the observer committee, they didn't fire a single bullet."

"Victory is close, god willing," he said.

Thousands turned out in the city of Idlib to welcome the observers, filling a large square, waving olive branches and flags, and chanting, "The people want the fall of Bashar."

But the ongoing violence in Syria, and questions about the human rights record of the head of the Arab League monitors, Sudanese Lt. Gen. Mohamed Ahmed Mustafa al-Dabi, are reinforcing the opposition's view that Syria's limited cooperation with the observers is merely a ploy by Assad to buy time and forestall more international condemnation and sanctions.

One of Assad's few remaining allies, Russia, voiced its approval of the observer mission so far, calling the situation "reassuring."

The Local Coordination Committees, an activist coalition, said at least 130 people, including six children, have been killed in Syria since the Arab League observers began their one-month mission.

On Friday, activists said security forces fired on protesters in Daraa, Hama, Idlib and Douma. In the central city of Homs, six people who were reported missing a day earlier were confirmed dead.

The Observatory reported 22 people were killed nationwide, most of them shot while protesting. The Local Coordination Committees activist network reported 32 were killed. The differing death tolls could not be immediately reconciled.

The Arab League plan, which Syria agreed to Dec. 19, demands that the government remove its security forces and heavy weapons from cities, start talks with the opposition and allow human rights workers and journalists into the country. It also calls for the release of all political prisoners.

Pro-Assad groups turned out for rallies in Damascus and several other cities, waving portraits of the president, in an apparent bid to show that the regime has popular support.

Also Friday, the rebel Free Syrian Army said it has stopped its offensive against government targets since the observers arrived, in a bid to avoid fueling government claims that it is facing armed "terrorists" rather than peaceful protesters.

"We stopped to show respect to Arab brothers, to prove that there are no armed gangs in Syria, and for the monitors to be able to go wherever they want," breakaway air force Col. Riad al-Asaad, leader of the FSA, told the AP by telephone from his base in Turkey.

"We only defend ourselves now. This is our right and the right of every human being," he said, adding that his group will resume attacks after the observers leave.

The Free Syrian Army says it has about 15,000 army defectors. The group has claimed responsibility for attacks on government installations that have killed scores of soldiers and members of the security forces.

Ill. court: Flying body part lawsuit can go forward

A "gory and creepy" lawsuit over an injury caused by a flying body part?can go forward in Chicago, an?Illinois appeals court has ruled.

The tragic case stems from a 2008 morning commuter accident at the Edgebrook Metra station, the Chicago Tribune reported Thursday.


?Hiroyuki Joho, 18, shielding himself from?pouring rain with an umbrella over his head, was hurrying to catch an inbound Metra train when he was struck by an southbound Amtrak train going more than 70 mph, the Tribune said.

The impact sent a large portion of his body flying 100 feet into Gayane Zokhrabov, then 58, who was waiting on the southbound train platform, the Tribune said.?Joho's body part knocked Zokhrabov to the floor, breaking her leg and wrist and injuring her shoulder.

Zokhrabov sued Joho's estate, but a Cook County judge ruled that Joho could not have anticipated her injuries, the Tribune said.

A state appeals court, however, disagreed, ruling that "it was reasonably forseeable" that the high-speed train would kill Joho and fling his body toward the people waiting on the platform.

Zokhrabov's lawyer, Leslie Rosen, told the Tribune that while the case was "very peculiar and gory and creepy," it was straightforward negligence on Joho's part.

Joho's mother, the Tribune said, sued Metra and Canadian Pacific Railway, claiming they were negligent by not announcing a Metra delay, which led to Joho's accident when he mistook which train was his.

The Tribune said Park's attorney Keith Davidson told the?newspaper he is appealing to the Illinois Supreme Court a Cook County judge's ruling that the railroads had no duty to warn about such an "open and obvious danger" as a moving train.

The Tribune cited three other cases, including one settled?for an undisclosed amount after?a train struck?a woman who was?following her sister across the?Edgebrook tracks two months after Joho's death.

In 1951, a postal worker?successfully sued after being hit by the body of an elderly woman?in Momence, Ill., who was struck by a train that was found to have been?operating at an?unsafe speed, the Tribune said.

Using MP3 players at high volume puts teens at risk for early hearing loss, say researchers

ScienceDaily (Dec. 28, 2011) ? Today's ubiquitous MP3 players permit users to listen to crystal-clear tunes at high volume for hours on end -- a marked improvement on the days of the Walkman. But according to Tel Aviv University research, these advances have also turned personal listening devices into a serious health hazard, with teenagers as the most at-risk group.

One in four teens is in danger of early hearing loss as a direct result of these listening habits, says Prof. Chava Muchnik of TAU's Department of Communication Disorders in the Stanley Steyer School of Health Professions at the Sackler Faculty of Medicine and the Sheba Medical Center. With her colleagues Dr. Ricky Kaplan-Neeman, Dr. Noam Amir, and Ester Shabtai, Prof. Muchnik studied teens' music listening habits and took acoustic measurements of preferred listening levels.

The results, published in the International Journal of Audiology, demonstrate clearly that teens have harmful music-listening habits when it comes to iPods and other MP3 devices. "In 10 or 20 years it will be too late to realize that an entire generation of young people is suffering from hearing problems much earlier than expected from natural aging," says Prof. Muchnik.

Hearing loss before middle age

Hearing loss caused by continuous exposure to loud noise is a slow and progressive process. People may not notice the harm they are causing until years of accumulated damage begin to take hold, warns Prof. Muchnik. Those who are misusing MP3 players today might find that their hearing begins to deteriorate as early as their 30's and 40's -- much earlier than past generations.

The first stage of the study included 289 participants aged 13 to 17. They were asked to answer questions about their habits on personal listening devices (PLDs) -- specifically, their preferred listening levels and the duration of their listening. In the second stage, measurements of these listening levels were performed on 74 teens in both quiet and noisy environments. The measured volume levels were used to calculate the potential risk to hearing according to damage risk criteria laid out by industrial health and safety regulations.

The study's findings are worrisome, says Prof. Muchnik. Eighty percent of teens use their PLDs regularly, with 21 percent listening from one to four hours daily, and eight percent listening more than four hours consecutively. Taken together with the acoustic measurement results, the data indicate that a quarter of the participants are at severe risk for hearing loss.

Dangerous decibels

Currently, industry-related health and safety regulations are the only benchmark for measuring the harm caused by continuous exposure to high volume noise. But there is a real need for additional music risk criteria in order to prevent music-induced hearing loss, Prof. Muchnik says. In the meantime, she recommends that manufacturers adopt the European standards that limit the output of PLDs to 100 decibels. Currently, maximum decibel levels can differ from model to model, but some can go up to 129 decibels.

Steps can also be taken by schools and parents, she says. Some school boards are developing programs to increase awareness of hearing health, such as the "Dangerous Decibels" program in Oregon schools, which provides early education on the subject. Teens could also choose over-the-ear headphones instead of the ear buds that commonly come with an iPod.

In the near future, the researchers will focus on the music listening habits of younger children, including pre-teens, and the development of advanced technological solutions to enable the safe use of PLDs.

This would be a blas? bit of news if 90 weren?t such a nice, round number, but, as it is, this represents a record of sorts. Not only did Barack Obama golf on Christmas day, but he hit the links yesterday, too ? and that round marked the 90th of his presidency. As Keith Koffler of WhiteHouseDossier.com points out, the time he?s spent on a golf course ? about four to five hours a round ? is the equivalent of three full months.

It?s not just that his perpetual self-indulgence signifies that ?kind of laziness? the president himself admits plagues him deep down. It?s also that this particular indulgence required an exceptional sacrifice from the military men and women who had to accommodate his desire to golf at the Marine Corps base. Melissa Clouthier breaks it down, including a few particularly devastating comments from wives of Marines:

Airport X-ray suitcase surprise: Poisonous snakes

(AP) ? Surprised airport workers in Argentina found hundreds of wriggling poisonous snakes and endangered reptiles inside the baggage of a Czech man who was about to board a flight to Spain.

Karel Abelovsky, 51, was made to open his baggage at Buenos Aires' international airport after police spotted reptiles in the X-ray scanner. They found 247 exotic and endangered species in all, packed inside plastic containers, bags and even socks, each labeled in Latin with their scientific names.

"The airport workers couldn't believe it when they saw the movement inside the suitcase. It was like an animated cartoon," a source in the office of Judge Marcelo Aguinsky said Tuesday. The source spoke on condition of anonymity because the judge's investigation isn't complete.

Abelovsky was released on about $2,500 bail after surrendering his passport and is refusing to talk even though even though he faces up to 10 years in prison.

Authorities believe the Czech was a courier for a criminal organization that smuggles exotic species whose exports are banned, a judicial source told The Associated Press on Tuesday. Authorities said Abelovsky only arrived in Argentina several days earlier and couldn't have had time to gather the animals alone.

Aguinsky believes the boa constrictors, poisonous pit vipers and coral snakes, lizards and spiders could have escaped the cloth suitcase in the unpressurized cabin of the Dec. 7 Iberia flight to Madrid, and perhaps attacked people there or at his final destination in Prague, where antidotes for South American snakes aren't common, the source added.

Most of the animals and bugs are being held under quarantine at the Buenos Aires Zoo, while some of the venomous snakes were sent to Argentina's national health institute, which has a high-security department where scientists develop antidotes using venom from snakes.

The species include lizards native to Mexico and snakes, spiders, snails and other species from northern Argentina, Paraguay and Brazil. Some were already dead in the suitcase, while others have succumbed to stress since then. Many were quite weak on arrival at the zoo, but most are still alive.

Wild snakes and reptiles are known to carry infectious diseases and so must be kept apart from the public and other animals, said Miguel Rivolta, the lead zoo veterinarian.

"It's difficult to find the right kind of bugs they eat, and to replicate as much as possible their environment in the wild," Rivolta said.

One suspect is in the hospital and police officers in Melbourne say they're looking for two others who broke into a home over the weekend.

Officers found one man, identified as Nathaniel Clay, collapsed in the back yard of the home. They think someone inside struck Clay with a baseball bat before one of his accomplices accidentally shot him.

The shooter was aiming for the homeowner but shot Clay, according to detectives.

Sony, Samsung dissolve panel joint venture

Japan's Sony and South Korean rival Samsung are dissolving their joint venture in liquid crystal display panels as Sony tries to stanch years of losses in its TV business.

Sony Corp. said Monday that Samsung Electronics Co. will buy all of Sony's shares in the joint venture for about 1.08 trillion Korean won ($935 million) subject to a final agreement.

The joint venture called S-LCD was set up in 2004. Sony, which fell behind in flat panel TVs, invested in a Samsung panel factory to ensure a steady supply of panels for its LCD TVs.

Sony's TV operation has lost money for seven straight years and the company is straining to return that key business to profit.

The prices of TVs as well as panels have been dropping so it makes more sense to buy panels at the market rate than to invest in production.

Sony, which makes Bravia TV sets, does not make its own LCD panels.

It said it will enter a new partnership with Samsung to buy panels, and will also continue buying panels from other manufacturers.

Sony said it will suffer a loss of 66 billion yen ($846 million) for the third quarter of this fiscal year, which ends later this month, because of the declining value of investment in S-LCD.

Getting out the production venture will produce substantial savings after January 2012, when the deal is completed, according to Sony.

It was still unclear how Sony's profit forecast for the fiscal year through March 2012 will be affected, said company spokesman Takashi Uehara.

LONDON - Manchester United managed the rare feat this season of outshining Manchester City's goal-scoring prowess on Wednesday to keep the pressure on its crosstown rival in the Premier League title race.

While City maintained its two-point lead over United with a 3-0 victory over Stoke, its second-place rivals routed Fulham 5-0 at Craven Cottage.

Such emphatic victories have been the norm for big-spending City this season, but for United it was the biggest in three months.

"It was very impressive, we've not scored as many as we'd like to but we'd been playing well," United winger Ryan Giggs said. "The second part of the season we always kick on and put in performances and that's pleasing."

Arsenal had more difficulties at Aston Villa, with Yossi Benayoun's late goal securing a 2-1 victory for his fifth-place side.

Liverpool is two points behind Arsenal after Charlie Adam missed a penalty kick in a 0-0 draw at Wigan. Luis Suarez featured for Liverpool a day after receiving an eight-match ban ? on hold pending any appeal ? for racially abusing United defender Patrice Evra.

United had failed to win on its past three visits to Craven Cottage but Danny Welbeck's fifth-minute opener, capitalizing on lax defending, was an early sign that the run would come to an end.
